Terms of Use

This is the agreement between you and TeachSmarts ("we", "us") for PDF Custard (the "Software"). By installing or using the Software, or by entering a licence key, you agree to it. If you don't agree, don't install or use the Software. This page summarises the full licence agreement, which ships as LICENSE.txt alongside the Software and is the governing document.

1. What you get

We grant you a personal, non-exclusive, non-transferable licence to install and use the Software. You receive a licence key by email, made out to the name and email address used at checkout. Any price is a one-off payment shown at checkout. The Software may be used during its trial period without a key; after that it needs a valid key.

2. Who can use it

The licence is for one person: the person named on the key. You may install and use the Software on any computers you own or personally control, for your own work, including preparing and marking teaching materials. Each additional person needs their own licence. A school or other organisation that wants to use the Software for several people needs a licence for each of them.

3. Updates

Your key covers every 1.x version of the Software, including updates we release during that time. A future major version (2.0 and beyond) may need a new licence, which we will tell you about before you buy or upgrade.

4. What you may not do

You may not:

• give, sell, rent, lend or publish your licence key, or the Software, to anyone else;
• copy or redistribute the Software, except for a backup copy for your own use;
• remove, bypass or tamper with the licence check, trial or update features;
• reverse engineer, decompile or modify the Software, except to the extent the law allows despite this restriction;
• use the Software to break the law or to infringe anyone's rights.

If you break these rules, your licence ends and we may disable your key.

5. Your documents and privacy

The Software processes your PDF documents on your own computer. It does not upload them to us or anyone else, and it has no accounts and no analytics. The Software connects to the internet only to check for updates and to check whether licensing is switched on. Neither sends the contents of your documents. See our Privacy Policy for details.

When you get a licence key, we collect your name and email address at checkout (through our payment provider, Stripe) to issue the key and to contact you about your licence and the Software.

You keep all rights to your documents. You are responsible for keeping copies of your files and for checking the results before you share them, especially any redactions.

6. Other people's software

The Software includes open-source software and fonts that belong to others and are used under their own licences. They are listed in THIRD_PARTY_NOTICES.txt, which is installed alongside the Software. Nothing in this agreement changes your rights under those licences.

7. Payment and refunds

The price, if any, and any refund terms are those shown at pdfcustard.teachsmarts.com when you get your licence.

8. No warranty, and limits on our liability

The Software is provided "as is". We try hard to make it reliable but we cannot promise that it will be error-free or suit every purpose. To the fullest extent the law allows, we are not liable for lost documents, lost data, lost profits or any indirect or consequential loss arising from use of the Software, and our total liability to you is limited to the price you paid for your licence.

Nothing in this agreement excludes or limits any right you have under consumer law that cannot lawfully be excluded or limited.

9. Ending the agreement

You can stop using the Software at any time by uninstalling it. We may end your licence if you break this agreement. When the licence ends you must stop using the Software and delete your copies.
